Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and [FILL: razão social], a company registered in Brazil under CNPJ [FILL: 00.000.000/0001-00], with its address at [FILL: street, number, city – state, ZIP, Brazil] ("Hypothetically", "we", "us"). They govern your use of the website at https://thehypothetically.shop and the video creation service offered there (together, the "Service").

By creating an account, buying a plan or credits, or otherwise using the Service, you agree to these Terms, to our Privacy Policy, Refund & Cancellation Policy, Acceptable Use Policy and Copyright Policy. If you do not agree, do not use the Service.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you confirm that you are authorized to accept these Terms for it, and "you" includes that company. The Service is not directed to children, and we do not knowingly collect information from anyone under 18.

2. What the Service does

Hypothetically turns a topic you provide into a short-form video. We generate a script with artificial intelligence, you review and approve it, and we then produce narration, illustrated scenes, captions and the final video file. An automated reviewer checks each video before it is shown to you, and you can approve it or ask us to redo individual scenes.

We may add, change or remove features, styles and formats over time. Features marked "coming soon" are not part of what you buy until they are released.

3. Your account

You are responsible for the accuracy of the information you give us, for keeping your password secure and for everything that happens under your account. Tell us right away at [email protected] if you suspect unauthorized access. One person may not create several accounts to obtain additional free usage.

4. Plans, credits and payment

Credits. Video generation is measured in credits. The number of credits an action uses (for example, a script, a full video or a scene redo) depends on its length and type and is shown before you confirm the action.

Subscriptions. Paid plans include a set number of credits each billing period. Unused plan credits expire at the end of each billing period and do not roll over unless the plan says otherwise.

Credit packs. You can buy extra credits at any time. Purchased credit packs remain valid for 12 months from the purchase date.

No cash value. Credits are a license to use the Service. They have no cash value, cannot be transferred or sold, and are not refundable except as described in the Refund & Cancellation Policy.

Prices and taxes. Prices are shown in US dollars on the website and at checkout. Prices do not include taxes unless stated; any applicable sales tax, VAT or similar tax is added at checkout. Your bank may charge foreign transaction or currency conversion fees, which we do not control.

Payment processing. Payments are processed by Stripe, Inc. and its affiliates ("Stripe"). We do not receive or store your full card number. By paying, you also agree to Stripe's terms that apply to you.

5. Automatic renewal

Your subscription renews automatically. When you subscribe, you authorize us (through Stripe) to charge the payment method on file the plan price, plus applicable taxes, at the start of each billing period (monthly, unless you choose another period offered at checkout) until you cancel.

• Before you pay, the checkout page shows the price, the billing period and that the plan renews automatically.
• After you subscribe, we email you a confirmation with these terms and instructions on how to cancel.
• If we change the price of your plan, we will notify you by email at least 30 days before the change applies to you. You can cancel before the new price takes effect.
• If a free trial or introductory price is offered, the checkout page states its length and the price that will be charged when it ends. Unless you cancel before the trial ends, your subscription starts at the regular price.

6. Cancellation

You can cancel at any time, online, from your account settings, with no need to contact us. You can also cancel by emailing [email protected]. Cancellation stops future renewals; your plan and its credits stay available until the end of the period you already paid for. Refunds are covered by the Refund & Cancellation Policy.

7. Your content and the videos you create

Your inputs. You keep all rights to the topics, text, images and other material you submit ("Inputs"). You give us a worldwide, non-exclusive, royalty-free license to host, process and transform your Inputs only as needed to provide and improve the Service and to keep it secure.

Your videos. As between you and us, you own the videos, scripts and other results generated for you ("Outputs"), and you may use them for any lawful purpose, including commercial use and monetized channels, subject to these Terms and to the rights of others. We will not publish your Outputs or use them in our marketing without your permission.

Similar results. Because AI systems can produce similar results for similar requests, other users may receive Outputs that resemble yours. Your ownership does not extend to those.

Your responsibility. You are responsible for your Inputs and for how you use your Outputs, including complying with the rules of the platforms where you publish them (for example, labeling AI-generated or synthetic content when a platform requires it) and with advertising, consumer protection and intellectual property laws.

8. AI-generated content

Outputs are produced with the help of artificial intelligence and may contain mistakes, outdated or inaccurate facts, or content that does not fit your purpose. Scripts that describe scientific, medical, safety or emergency topics are for entertainment and general information only and are not professional advice. Review every script and video before you publish it.

9. Acceptable use

You agree to follow our Acceptable Use Policy. In short, do not use the Service to create content that is illegal, that impersonates or sexualizes real people, that deceives viewers about real events, or that infringes the rights of others, and do not try to abuse free usage or interfere with the Service.

10. Our intellectual property

The Service, including its software, visual styles, templates, characters, sound library, brand and website, belongs to us or our licensors and is protected by law. Except for your rights in your Outputs, these Terms do not give you any right to our intellectual property. You may not copy, resell, reverse engineer or build a competing service from the Service.

11. Third-party services

The Service relies on third-party providers, such as payment processing, cloud hosting, AI models and voice synthesis. Their availability is outside our control, and their own terms may apply to you when you interact with them directly.

12. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or close your account if you materially breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or other users. When reasonably possible, we will tell you why and give you a chance to fix the problem. If we close your account without cause, we will refund the unused portion of any prepaid period and credit packs.

13. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that your videos will reach any number of views, followers or earnings.

14. Limitation of liability

To the fullest extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence or willful misconduct.

15. Indemnity

You will defend and indemnify us against third-party claims, damages and costs (including reasonable attorneys' fees) arising from your Inputs, your use of your Outputs or your breach of these Terms, except to the extent caused by our own breach.

16. Governing law and disputes

These Terms are governed by the laws of the Federative Republic of Brazil. Before starting any formal proceeding, please email [email protected] so we can try to solve the issue informally within 30 days.

If you are a consumer, nothing in these Terms removes the protections you have under the mandatory consumer laws of the country or US state where you live, and you may bring a claim in the courts of your place of residence where that law allows it. Otherwise, the courts of the city of our registered address in Brazil have jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or in the Service at least 15 days before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not agree, cancel before that date.

18. General

These Terms, together with the policies linked above, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. If there is a conflict between the English and Portuguese versions, the English version prevails, except where Brazilian law requires the Portuguese version to prevail for Brazilian consumers.
